Users agree to access only information they are authorized to access.
5. Customer data
As between Arkup and the customer, customers retain their ownership rights in information, files, documents and business content submitted to Arkup, subject to any rights belonging to third parties.
The customer grants Arkup the limited rights necessary to host, process, transmit, analyze and display customer data solely to provide, secure, support and operate the Arkup service.
6. Connected services
Users may connect third-party services. By connecting a service, the user authorizes Arkup to access and process information permitted by the permissions the user grants.
Third-party services remain subject to their own terms and privacy policies. Arkup is not responsible for the independent operation of third-party services.
7. Google data
Arkup's use of information obtained through Google APIs complies with Google's applicable API policies and Limited Use requirements. Users control whether they authorize Google integrations and may revoke access at any time. See the Privacy Policy for detail.
8. Artificial intelligence
Arkup includes AI-assisted functionality. AI-generated outputs may contain inaccuracies, omissions or incomplete information.
Users should independently review important outputs before relying on them for legal, financial, medical, safety-critical, employment, regulatory or other high-impact decisions. Arkup does not guarantee that AI-generated content will always be complete or error-free.
9. User responsibilities

Recurring subscriptions may renew automatically unless canceled according to the applicable subscription terms. Usage-based fees, add-ons or overage charges may apply where disclosed. Taxes may apply.
11. Service changes
Arkup may improve, modify, add or discontinue features. Where commercially reasonable, Arkup may provide notice of material changes that significantly affect paid customers.

Arkup aims to provide a reliable service but does not guarantee uninterrupted or error-free availability unless a separate written Service Level Agreement applies.
13. Confidentiality
Each party may receive confidential information from the other. Confidential information should only be used as necessary to fulfill the relationship between the parties and should be protected using reasonable safeguards.

These Terms do not transfer Arkup intellectual property ownership to users.
15. Feedback
If users voluntarily provide product feedback or suggestions, Arkup may use that feedback to improve the service without obligation to compensate the user, provided Arkup does not use customer confidential information outside the permitted purposes.

Following account or subscription termination, customer data may be retained temporarily for operational, legal, security or backup purposes and may later be deleted according to Arkup's retention practices. Organizations should export necessary data before terminating services where export functionality is available. See the Data Deletion page.
18. Disclaimers
To the maximum extent permitted by applicable law, Arkup is provided on an "as available" basis. Arkup does not guarantee that all AI outputs, analyses, recommendations, forecasts or generated materials will be accurate or suitable for every purpose.
19. Limitation of liability
To the maximum extent permitted by applicable law, Arkup's liability arising out of or relating to the service is limited, and Arkup is not liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits, revenue, goodwill or data.
Nothing in these Terms limits liability that cannot be limited under applicable law. A separately negotiated enterprise agreement or order form may contain additional or different liability provisions, which will control for that customer.
20. Indemnification
Users and organizations may be responsible for claims arising from their unlawful use of Arkup, from information they were not authorized to submit or connect, or from material violations of these Terms, subject to applicable law and to any separate written agreement between the parties.
